Undue Burden
Estes Park Schools are dedicated to ensuring accessible services and equitable opportunities for all students, staff, and community members, including those with disabilities. However, certain scenarios may arise where achieving full compliance with accessibility standards presents challenges due to:
- Undue Burden: Implementing certain accessibility measures could impose significant financial, technical, or administrative challenges that may compromise the school district's ability to provide essential educational services effectively.
- Fundamental Alteration: Full compliance with accessibility requirements could, in some cases, fundamentally alter the nature of a program, service, or activity, potentially rendering it impractical or unworkable.
- Direct Threat: Rare situations might arise where full compliance poses a direct threat to the health or safety of individuals. In such cases, risk assessments and alternative solutions will be considered.
In these instances, Estes Park Schools will:
- Provide Justification: Clearly document and explain the specific circumstances that prevent full compliance with accessibility standards.
- Pursue Alternatives: Identify and implement alternative accommodations that address accessibility needs while minimizing undue burden, avoiding fundamental alteration, and mitigating direct threats. These alternatives may include alternative formats, assistive technology, or personalized communication strategies.
Ongoing Commitments
Estes Park Schools are committed to providing accessible content and services wherever feasible. Priorities include identifying effective tools for PDF and Word document remediation, improving website accessibility, and shifting staff culture to incorporate accessibility into the creation of all new content. Regular evaluations of accessibility initiatives will ensure compliance continues to improve as training, resources, and finances allow.
